Firm gets Favorable Outcome in Pursuit of Prosecution and Award of Restitution for Fraudulent Insurance Claim Filing
The applicant filed a specific injury claim on 10/15/18 to the right leg, knee, ankle and foot, that was initially accepted and referred for defense litigation assistance. Through the initial discovery process it was learned that the claim was likely fabricated, and surveillance efforts were then initiated, and were coupled with a deposition that was geared toward the suspected fraud aspect of the claim, with the investigator coordinating with defense counsel during and following the deposition. Following completion of the deposition process, during which the applicant perjured himself several times, the matter was referred to SIU for investigation, and subsequently referred to the district attorney for prosecution. In conjunction with that prosecution, the applicant pleaded no contest to a violation of the penal code related to filing fraudulent insurance claims, and was ordered to pay $27,786.68 in restitution to the client, in addition to 1 year of probation and 160 hours of community service.
