The applicant filed a cumulative trauma claim alleging back and hip injuries from September 17, 2017 through September 17, 2018. The claim was denied due to a lack of medical and factual evidence. After securing a favorable Qualified Medical Evaluator in our preferred medical specialty of MOS Orthopedic Surgery, Applicant’s counsel tried on numerous occasions to get the QME and his reporting removed at the WCAB, with the court siding with our arguments each time. We ultimately took the claim to trial and prevailed by receiving a take-nothing.
